These terms and conditions apply to the use of Flowers For Kicks website and other selling platforms and marketing outlets. Please read the Terms and Conditions carefully.

By using this website, joining our mailing list, emailing us, engaging with our social media platforms and/or placing an order/purchasing from us, you agree to be bound by the terms and conditions set out below. This website and services offered are available to users that are 18 years or older. By using this website and/or services, you represent and warrant that you are of legal age to form a binding contract and meet all the eligibility requirements.

Amendments:

We reserve the right to update or replace our terms and conditions at any time and without prior notice. Any amendments will be posted on this page. The most current version of the Terms and Conditions will supersede all previous versions. Please do read our Terms and Conditions, Privacy and Cookies policy prior to contacting us or making an order. You are expected to check this page periodically so that you can review any changes, as they are binding on you.

We also reserve the right to withdraw or amend this website and any service or product we provide on the website at our sole discretion and without notice. We will not be liable if for any reason all or part of the website is unavailable at any time and for any period.

You agree that the information on this website may be erroneous and agree to take due diligence to verify any information obtained from this website and agree not to rely upon any information contained in this website.

You agree to take full responsibility for any harm or damage you suffer as a result of the use of the information, products and services available through Flowers for Kicks.

Liability:

We are not liable for any consequential or incidental damages, including but not limited to damage to self or personal property. Our liability is limited to the purchase price of the order. We are not responsible for any misuse of our products or services. You agree to absolve us of any and all liability or loss that you may suffer or incur as a result of use of the information or product or service provided by us.

Toxicity Warning:

All arrangements are for ornamental purposes only. Some flowers can be harmful and toxic is consumed and medical attention should be sought in this event. For the purpose of safety, all flowers should be considered toxic and kept out of reach of children, pets and the vulnerable. Some flowers may also cause skin or eye irritation and so you are strongly advised to wash your hands thoroughly after handling. Once our product is delivered, it is the recipient’s responsibility to use it safely and we cannot be held liable for any damages or injuries that may occur from handling our products.

Exceptional and Unforeseen Circumstances:

We will always aim to be fully operational but cannot guarantee this. There are certain situations or events, beyond our reasonable control that may prevent us from fulfilling our obligations. Some examples of such events may be ill health, adverse weather conditions, traffic accidents/severe traffic and delays in receiving our flowers. This is not an extensive list and there may be other incidents that prevent us from fulfilling orders. If we cannot fulfil our obligation a refund will be issued for the cost of the undelivered product only, and no compensation will exceed this amount.

Flower Quality:

We supply seasonal British flowers. Photographs are illustrative only and not representative of the exact flowers or arrangement you will receive. Flowers are natural products and variation in size, colour, shape and length of life is to be expected. We cannot promise specific varieties, colours or exact amounts of stems per arrangement as there are fluctuations in availability and wholesale cost. All our flowers are properly conditioned prior to delivery. Once the flowers are received, it is the responsibility of the recipient to follow our flower care and safety guide to obtain the best vase life. We do not accept liability for flowers that have not lasted as long as they should if it is apparent that the care guidelines have not been correctly followed.

Longevity of Flowers:

We do not guarantee vase life, as the longevity of a bouquet differs according to the different flowers used. It is also dependent on the conditions in which they are placed once the recipient has them. Unlike the majority of imported blooms, we try and source flowers which have been grown with little or no chemicals. British flowers therefore may not last as long as imported flowers that are scentless and have been chemically treated. We advise unpacking the flowers immediately and placing them in a clean vase with fresh water. They should be positioned in a cool area, away from heat sources and out of direct sunlight. They should not be placed directly on furniture and should be kept away from ripening fruit, especially bananas. Fading stems should be removed from the arrangement as they can spread bacteria to the healthy ones. The recipient should re trim the stems by 2-3 cm at a 45 degree angle and change the water every 2-3 days, removing any leaves that sit below the water level.

Prices:

The price of our products will be quoted on our website except in cases of obvious error. The prices are liable to change at any time and we reserve the right to modify or discontinue a service without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuation of a service.

Refusal of Transaction:

We reserve the right to refuse to process an order for any reason, or refuse service to anyone at our sole discretion and at any time during the ordering process.

Order Placement and Confirmation:

You can place an order through our website, hosted by Squarespace. We will confirm your order details via email after placing your order. Please ensure all details are accurate, as we are not responsible for errors or omissions in your order. You agree that you have read and accepted our terms and conditions before placing your order. By placing your order with us, you agree to be bound by these terms and conditions and warrant that you are 18 years of age or older.

Delivery:

Our local delivery option for subscription is only available within the named delivery area. For gift bouquets, please be sure that the address given is a deliverable address. Deliveries may be made by our team or a third-party delivery service. We will make reasonable efforts to deliver your order on time. We do not accept liability for unsuccessful deliveries due to factors beyond our control, including, but not limited to, illness, adverse weather conditions and traffic incidents.

We primarily use local couriers or DPD to deliver our bouquets. For gift bouquets, you will receive a one hour delivery time slot from DPD. This will include a tracking link and further delivery instructions. We have no control over this information and cannot be held responsible for flowers being delivered outside of the allocated time slot.

It is the customer or the recipients responsibility to give clear instructions to the courier as to where to leave the flowers should they not be there to receive them. We cannot offer re deliveries, so this information must be provided. The safe space should be a cool, sheltered space away from direct sunlight, wind and rain. We do not accept any liability for loss or damage to flowers that have been left in the designated safe space.

Once the flowers have been received from the courier we are unable to make any amendments. It is the customers responsibility to check that the delivery address and details are correct. We do not accept any liability for incorrect delivery details being submitted or not providing a safe space to leave the flowers should the recipient not be in. We do not accept any responsibility for loss or damage to bouquets that have been left outside of the property due to the recipient not being in at the time of delivery, and cannot offer re delivery. If some stems have drooped during the delivery process, place in a cool spot in fresh cool water on arrival and they should perk up after 24 hours.

Subscription Details:

Your first delivery will be paid for when you set up your subscription, after which, payments will be taken 6 days before your delivery is due. Your subscription can be cancelled by logging in to your account. If you are away you can divert your subscription delivery to another recipient that lives in the local delivery catchment. If you choose to do this you must take full responsibility for communicating the full Terms and Conditions listed on this website to the recipient. To temporarily divert your subscription, please email us directly on flowersforkicks@gmail.com and we will be happy to help. Cancellations or amendments need to be made at least 7 days prior to the next delivery due. If changes are made later than this, you will receive and be charged for your next delivery, following which the cancellation/amendment will take place.

For subscription deliveries our local courier will deliver the flowers on a Friday. There is no time slot given and it is the customers responsibility to leave information providing a safe space to leave the flowers should they not be home. This information can be provided when placing the order on the website. This safe space should be a cool, sheltered space away from direct sunlight, wind and rain. We do not accept any liability for loss or damage to flowers that have been left in the designated safe space.

Amendments/Refunds/Cancellation Policy:

Once you have placed an order for a gift bouquet, it cannot be cancelled. You can cancel your subscription at any point but if you cancel with under one week until your next scheduled delivery, then that delivery and payment will be fulfilled. Your subscription will then cancel automatically.

Photography and Marketing:

We reserve the right to photograph all arrangements and use these images for marketing on our social media platforms and website.

Complaints:

We hope you love your flowers. If you have an issue with your flowers then we will strive to make this right. We ask that you provide a clear photograph of the flowers and further details upon receipt of your delivery, and no later than 24 hours after delivery. Compensation is offered at our discretion and we do not accept liability for flowers that have not been properly cared for (following our care and safety guide or the information included in the longevity section above), or have been left in an inappropriate safe space. If compensation is offered it will never exceed the value of the product received.

Intellectual Property Rights:

All intellectual property rights regarding the Flowers For Kicks website, including, but not limited to, text, graphics, designs, logos, photographs, images and all other materials are owned by Flowers For Kicks. No content may be copied, reproduced, sold or used without prior written consent.

Governing Law:

These terms and conditions are governed by English Law. Any dispute that may arise will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
